In cooperation with the Center for Education of Judges and Prosecutors of Federation BiH (CEST F BiH), EU4Justice organised two-day workshop “Ethics and Integrity” for over 45 judges and prosecutors from various Courts and Prosecutors Offices in BiH.
The topic “Independence and impartiality of judges” was presented by Ms Aleksandra Martinović, President of the Constitutional Court of the Federation BiH.
“The judge is independent in the performance of their function in relation to the legislative and executive authorities, to the public, to the media and other institutions of the society, as well as to the specific parties to the proceedings.” – highlighted Ms Martinović during her presentation.
Ms Isabelle Arnal EU4Justice Team Leader in her comments emphasised that all members of the judiciary are expected to maintain the highest standards of ethics integrity in all aspects of their work and life during their whole career.
“It is part of the need for a longstanding commitment from all the judiciary to ensuring that ethics and integrity is not only a topic to be dealt with during the initial education but is on the agenda during the in -service training as well”. – stated Ms Arnal.
Mr Mirza Hadžiomerović, Deputy Chief Disciplinary Counsel, Office of the Disciplinary Counsel spoke to the participants in detail about disciplinary proceedings and practice focusing on: Codes of Judicial and Prosecutorial Ethics; Discussion of selected cases from practice/hypothetical cases; and Accepting gifts; public speaking; and exemption.
Ms Cristiana Macchiusi, Inspector in the Ministry of Justice of Italy was one of the key speakers presenting the topic “Sources of disciplinary liability of magistrates in the Italian system: complaints, sanctions and remedies”. Ms Macchiusi also presented two case studies specifically developed for this workshop. The participants had the opportunity to discuss the details of these cases.
Ms Aldijana Porča, Disciplinary Counsel, Office of the Disciplinary Counsel discussed with participants selected cases from practice but also some hypothetical cases. During her presentation she also focused on using of social networks; incompatible and additional activities; and communication with clients.
The workshop was characterised with lively discussion and active contribution of the participants.
EU4Justice Project is promoting EU best practices and standards on ethical and professional conduct, which are crucial to the judiciary and prosecutorial systems.
