The interest for the theme “International instruments in combatting corruption, a practical approach” of the online training, jointly organised with CEST FBiH and CEST RS, was confirmed by close to 60 participants, representing judiciary and law enforcement agencies.
Mr Vincent Filhol, prosecutor, French Ministry of Foreign Affairs discussed the practical experiences when activating anticorruption legal instruments. Mr Filhol prepared two case studies through which the following issues were raised and discussed:
- Knowledge of the facts of corruption and the opening of the investigation (national and international authorities, voluntary disclosures, complaints, anonymous denunciations, etc.)
- The perpetrators of corruption and the impact on the investigation: natural persons, legal persons; facilitators and accomplices
- The application of criminal law in space (non bis in idem principle; extraterritoriality in matters of corruption)
- Mutual legal assistance in matters of international corruption
- Attention points in the investigation: immunities, disclosure obligations, prescription of facts or public action …
- Investigations and legal proceedings carried out by several countries
The EU4Justice is planning additional training sessions on this theme in near future. Interested participants will be able to apply through the CEST FBIH and CEST RS, once the training is scheduled.
