Mutual legal assistance in criminal matters and extradition workshop

EU4Justice project, in cooperation with CEST FBiH and CEST RS, is organising an online training for judges and prosecutors Mutual legal assistance in criminal matters and extradition” (MLA).

Mutual legal assistance in criminal matters is a process, generally governed by treaty or authorized by domestic law, by which countries seek and provide information that may be used as evidence in criminal cases. In a world where everything is accelerating and where criminals are building increasingly trans and international networks, legal international cooperation has become more and more key to addressing these challenges.

The goal of the workshop which will be held on May 27th from 09:30-12:30h via Zoom platform is to raise awareness of various procedural pathways, legal bases and practice between Bosnia and Herzegovina and other countries with distinguished information about the Republic of Serbia, Republic of Croatia, the Federal Republic of Germany, the United States of America and the People’s Republic of China. Simultaneous translation will be provided.

The EU4Justice Project has developed the “Guide on mutual legal assistance in criminal matters and extradition” to share the working methodology, practice, and advice with prosecutors and judges to enable them to deal more efficiently with their cases of an international character. The Guide will be also presented at the workshop by the two experts who have developed it Mr Bernard Rabatel and Mr Nikola Sladoje.

Mr Bernard RABATEL has been a member of the French Judiciary (magistrate) for 40 years. From January 2014 until June 2018, he held the position of Prosecutor General (procureur general) of the court of appeal of Fort de France (Martinique). From July 2012 until December 2013, he was acting as a Deputy Prosecutor General (avocat général) at the Court of the appeal of Lyon (France). From March 2008 until June 2012, he was seconded as Deputy Head of Justice of the European Union Rule of Law Mission in Kosovo (EULEX KOSOVO). From 2002 until 2007, he served as a Liaison Magistrate between France and the United Kingdom. He had an office at the Home Office, Judicial Cooperation Unit. He also worked with the French Embassy in London as an adviser for judicial affairs. In these capacities, he was responsible for facilitating legal cooperation between the United Kingdom and France in such areas as international judicial assistance, extradition procedures, transfers of prisoners, and the application of the Hague Convention on the Civil Aspects of International Parental Abduction. From 1996 until 2001, he was appointed Liaison Magistrate (Senior Liaison Legal Advisor), in Washington, D.C., at the United States Department of Justice, Criminal Division, Office of International Affairs and an adviser for judicial affairs at the French Embassy in the United States.

Since the year 2000, Mr Nikola Sladoje performed various duties in the Ministry of Justice of BiH. Since 2004 he has been working as the Assistant Minister of Justice of BiH and as the Head of the Sector for Mutual Legal Assistance and Cooperation in Criminal and Civil Matters (contact point on behalf of BiH in all court proceedings for communication with foreign countries). As a team leader, he participated in drafting the first criminal procedure codes, codes on civil procedure, and many other laws at the level of BiH. At the same time, since 2008, he has been the Chairperson or a member of the National Commission administering the professional administrative exam to work in administration bodies with a university degree qualification. Mr Sladoje is a member of the tripartite negotiation team of Bosnia and Herzegovina for concluding international agreements in the field of mutual legal assistance (he participated as a negotiator in concluding all international agreements in the field of mutual legal assistance, which Bosnia and Herzegovina concluded with other countries in the period from 2003 until today). As an educator and in the field of Mutual Legal Assistance in Civil and Criminal Matters, he held over fifty seminars on “Provision of Mutual Legal Assistance “. He has participated in several international and regional conferences related to criminal, civil and international law.
