EU4Justice project, in cooperation with CEST FBiH and CEST RS, is organising an online training for judges and prosecutors “International instruments in combatting corruption, a practical approach” in aiming to raise awareness of the prosecutors, judges, members of LEAs, investigators on practical experience in activating anti-corruption legal instruments. The training will be held on the ZOOM platform, and simultaneous interpretation will be provided. The purpose of the workshop is to share a practical experience and pragmatic approach from an experienced French prosecutor, Mr Vincent FILHOL. For ensuring a more interactive session, Mr Filhol will base his intervention on two practical cases which have been elaborated on based on existing cases. The objective of this methodology is to identify and isolate specific situations of interest for practitioners. This module will be a room for exchange of experience and further interactive talks on sensitive cases.
The themes that will be addressed and discussed are:
- Knowledge of the facts of corruption and the opening of the investigation (national and international authorities, voluntary disclosures, complaints, anonymous denunciations, etc.)
- The perpetrators of corruption and the impact on the investigation: natural persons, legal persons; facilitators and accomplices
- The application of criminal law in space (non-bis in idem principle; extraterritoriality in matters of corruption)
- Mutual legal assistance in matters of international corruption
- Attention points in the investigation: immunities, disclosure obligations, prescription of facts or public action
- Investigations and legal proceedings carried out by several countries
